AI Progress Statement on Pivotal Fair Use Decision in AI Copyright Case

Statement attributable to Anna Chauvet, AI Progress Advisor:

“In a significant ruling, the U.S. District Court for the Northern District of California has held that using copyrighted works to train large language models is fair use under U.S. copyright law. Crucially, the court found this use is “exceedingly transformative” and does not displace demand for or harm the market for the original works.

This ruling acknowledges the truly transformative nature of AI technology and underscores that using copyrighted works to train large language models fits squarely within the scope of fair use and aligns with long-standing legal principles.”
